If sufficient evidence is shown that there are none available, the employer may then submit a PERM labor certification application in order to bring in foreign workers for labor.

  • The offered wage must be equal to or greater than the prevailing wage for the occupation
  • There are no other U.S. workers who are qualified, available, and willing to accept the job
  • The employment will not adversely affect the wages and conditions of U.S. workers
  • The employee meets the specific educational and work requirements of the position at the time of filing
  • The employee maintains valid legal status if living within the U.S.
