H-1B visas allow foreign nationals in a specialty occupation to work in the United States for a temporary period of time. An individual may hold their H-1B status for up to six years, and it may be issued in increments of up to three years by the United States Citizenship and Immigration Services (USCIS). In certain circumstances, the status may be extended beyond the initial six years.
Below are the requirements for obtaining an H-1B visa:
- There must exist an employer-employee relationship, meaning that the employer is able to hire, pay, fire, supervise, or otherwise control the work of the employee
- The employer must petition on behalf of the employee
- The employee must meet the requirements of being in a specialty occupation through having a bachelor's degree or equivalent experience
- The job must be in a specialty occupation related to the employee's field of study
- The employee must be paid the actual or prevailing wage for the occupation, depending on which is higher
- Unless the petition is exempt from numerical limits, an H-1B visa number must be available at the time of filing the petition
