EB-5 Visa Eligibility
There are two circumstances that can qualify for an investor for an EB-5 visa from the USCIS. One is if they intend to create at least 10 full-time jobs within two years of receiving the visa (or indirectly create or preserve jobs). The second possible qualification is if the applicant is looking to invest in a new commercial enterprise.
A “new commercial enterprise” must:
- Be founded after November 29, 1990, or
- Be founded before November 29, 1990 but has been purchased and reorganized
- Be founded before November 29, 1990 but will expand 40% or more via the investment
