Benefits You Can Receive
Obtaining an H-2A visa allows foreign nationals to work a temporary or seasonal agriculture job in the United States. In order to begin the process, you must have a standing offer of employment and the employer must meet several requirements. If the requirements are all met, the employer may then petition the U.S. government to bring the foreign worker to the country. Workers with an H-2A visa are allowed to remain in the country for a total of 365 days.
To qualify for H-2A nonimmigrant classification, you must show that:
- The job that the employer is offering is temporary or seasonal in nature
- There is not a sufficient amount of U.S. workers who are able, willing, or qualified to do the job
- The employment of foreign temporary workers will not negatively affect the wages and working conditions of U.S. workers who are at a similar job
- The visa holder intends to return to his or her home country after the expiration date

Even though the visa only extends for a relatively short period of time, it does provide numerous benefits to the holder. Qualifying spouses and dependents may be allowed to enter the country and the worker is given unrestricted ingress and egress into the U.S. during the 365 days. In addition to this, visa holders are entitled to prevailing wages, standards of employment, and worker's compensation benefits, as well as certain housing and education benefits for them and their family. In some situations, the H-2A may be extended indefinitely.
